Collateral Warranty Agreement
For use where the employer and a specialist sub contractor
wish to create a separate contractual link with each other, in
addition to the principal contractual route via the main contractor.
Changes to the law on negligence have led to rapidly growing
demand from clients, property developers, property owners
and other related parties for collateral warranties to be
provided by the specialist sub contractors and suppliers who
nowadays provide most of the actual design/
manufacture/supply/installation input into construction
projects. Many of the individual forms of collateral warranty
which clients and others seek to use contain potentially hazardous
and unduly widely drawn provisions, and can often
impose potentially suicidal liabilities on to the unwary specialist.
The Confederation’s Collateral Warranty Agreement seeks
to provide a compromise between the reasonable requirements
of the employer and the reasonable willingness of the
specialist to warrant his work.
